·The contractor agrees and the undertakes to commerce and complete the
construction within 8 months subject however to the condition the company
effects payments in time as mentioned in stages of payment and further subject
to the condition that the contractor shall not be held responsible for any
delay in construction due to no payment on time.
· If there is no payment on time as mentioned in stages of payment with
mentioned date, then the work will be stopped after sending two notices within
a seven days period of time to the owner and then the work is started again
after the payment received.
·The Contractor agrees and undertakes to make arrangement for skilled,
unskilled and other labour/manpower necessary for the construction work along
with other necessary construction equipments machinery and tools for the
purposes of construction of the building. Payments for the labour employed are
the responsibility of the contractor inclusive of any claim arising in the
course of employment relating to the construction of the building.
·The contractor is responsible for safety issues like injuries, accidents
happened at site and other labour related issues and he needs to compensate,
the contractor will also take third party insurance coverage.
·All materials not confirming to the requirements of these specifications
shall be considered as defective and all such materials shall be removed
immediately by the contractor at his expenses and replaced with acceptable
material.
·The contractor agrees to execute additional works deviations as required
by the owner with additional cost.
·The contractor agrees to do and perform all works and incidental and
necessary for the proper execution and completion of the building and shall
supply all and any additional labor and materials necessary to complete the
works in the stipulated time.
·The contractor agrees to insure all building materials insurable, labor
and agrees not to have recourse to the company for any loss, damage or theft
thereof.
· In the case of dispute or difference the matter shall be decided only by
the Arbitration and the provisions of the Indian Arbitration Act shall apply.
· Execution of civil works like electricity, plumbing, flooring, joinery,
etc including supplying and fixing off all materials for all items of work. All
works shall conform to the supplying and fixing of all materials for all items
of work. All works shall confirm to the general and particular specifications
and as per the general layout and detailed drawings given.
· All works are to be completed in all respects within eight months. A
detailed programmer of works in a ‘BAR CHART’ form listing out various
construction activities are to be submitted.
· All the glass (mirror) items and glass partition for the doors at
inside the toilet shower will be provided by the client (owners).
· The free complementary work is added to in the kitchen room self wooden
work without any special cost. Also the remaining room including/wash basin
bottom side wooden work has to do with owner own cost.
· Apart from the building execution, the total cost is included with the
additional works are like compound wall-5 ft height, septic tank-6000 liter
capacity, water storage sump-6000 liter capacity, and water tank at roof
top-1000 liter for drinking and 2000 liter for bore water.
· The contractor needs to do the free maintenance (warranty support
towards construction issues on civil, MEP, and on the other areas) to the
owners with 12 months period of time from the date of handing over.
